Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Krishnaa Technologies ("Company," "we," "our," or "us"), governing your access to and use of our website krishnaa.co.in, our services, and any related applications or platforms.

By accessing our website, subscribing to our services, or completing any transaction, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.

Services Overview

Krishnaa Technologies provides the following services and products:

• Cable Television distribution services (under DAS License: N-45009/18/2024-DAS)
• Broadband internet services
• IPTV and OTT streaming services
• B-CAS (Bharat Conditional Access System) technology solutions
• B-Vission CCTV and surveillance products
• Set Top Boxes (STB), GPON equipment, and related accessories
• Digital content, software, and technology services

Eligibility

To use our services, you must:

• Be at least 18 years of age or the age of legal majority in your jurisdiction
• Have the legal capacity to enter into a binding agreement
• Provide accurate and complete information during registration or subscription
• Comply with all applicable Indian laws, including TRAI regulations for cable TV and broadband services

User Account and Responsibilities

When you create an account or subscribe to our services:

• You are responsible for maintaining the confidentiality of your account credentials
• You must promptly notify us of any unauthorized access to your account
• You are responsible for all activities that occur under your account
• You agree to provide current, accurate, and complete information and keep it updated
• We reserve the right to suspend or terminate accounts that violate these Terms

Payments and Billing

By making a payment through our platform, you agree to the following:

• All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise
• Payments are processed through secure, PCI-DSS compliant third-party payment gateways
• You authorize us to charge the payment method provided for the services or products you have selected
• Subscription fees are billed in advance on a recurring basis (monthly/quarterly/annually) as per your chosen plan
• Failure to make timely payments may result in suspension or disconnection of services as per TRAI guidelines
• All applicable taxes, NCF charges, and government levies will be added to the base price as required by law

We reserve the right to modify pricing with prior notice. Price changes for existing subscriptions will be communicated at least 30 days in advance.

Service-Specific Terms

Cable TV Services

• Cable TV services are governed by TRAI regulations and the terms of our DAS license
• Channel lineup and availability may change based on broadcaster agreements and TRAI orders
• NCF (Network Capacity Fee) is as per TRAI regulations: Rs.130 per month + applicable taxes for up to 200 SD channels

Digital Products and Services

• Digital products (including software, digital content, IPTV subscriptions, and CAS licenses) are delivered electronically
• Access to digital products is granted upon successful payment confirmation
• Digital products are for personal, non-commercial use unless a commercial license is purchased
• Redistribution, resale, or unauthorized sharing of digital products is strictly prohibited

Prohibited Activities

You agree not to engage in any of the following activities:

• Using our services for any unlawful purpose or in violation of any applicable laws
• Tampering with, modifying, or reverse-engineering any hardware (including STBs) or software provided by us
• Unauthorized redistribution, retransmission, or sharing of our cable TV signals or digital content
• Attempting to bypass, disable, or interfere with any security features of our services
• Using automated systems, bots, or scripts to access our website or services
• Providing false or misleading information during registration or transactions
• Engaging in any activity that disrupts or interferes with our services or infrastructure

Intellectual Property

All content, materials, trademarks, logos, software, and intellectual property displayed on our website and associated with our services (including B-CAS, B-Vission, and B-Digital brands) are the property of Krishnaa Technologies or its licensors.

• You may not copy, reproduce, distribute, or create derivative works from any of our content without prior written consent
• The Krishnaa Technologies name, logo, and all related brand names are registered trademarks
• Any unauthorized use of our intellectual property may result in legal action

Limitation of Liability

To the maximum extent permitted by applicable law:

• Krishnaa Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services
• Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim
• We do not guarantee uninterrupted, error-free, or secure access to our services at all times
• Service interruptions may occur due to maintenance, technical issues, natural disasters, or circumstances beyond our control

Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties regarding the accuracy, reliability, or completeness of any content
• Warranties that our services will meet your specific requirements

Cancellation and Termination

• You may request cancellation of your subscription by contacting our support team
• Cancellation requests must be submitted at least 7 days before the next billing cycle
• We reserve the right to terminate or suspend your account for violation of these Terms
• Upon termination, your right to use our services will cease immediately
• Any outstanding payments remain due upon termination

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of our services shall be:

• First attempted to be resolved through amicable negotiation
• If unresolved, submitted to mediation or arbitration in accordance with the Arbitration and Conciliation Act, 1996
• Subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The unenforceable provision shall be replaced with an enforceable provision that most closely reflects the intent of the original provision.

Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify you through email or a notice on our website.
